29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Dafina Construction, Inc. at 461 Railroad Ave, Gypsum, CO 81637: On or before May 7, 2019 the controlling and creating employer did not ensure that subcontractor employees were protected from injury while they installed concrete footers at the bottom of a foundation excavation, in that a protective system was not used. Subcontractor employees installed footers in close proximity to the 12 foot vertical excavation side walls. The excavation was approximately 33 feet by 45 feet. This condition exposed subcontractor employees to a crushing hazard by excavation wall cave-in.
