(a) Final Touch Construction, LLC., on or about June 18th, 2019, at the location of 2363/2365 Manchester Ln., Avon, OH, 44011: The employer did not have an accident prevention program or plan to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falling objects and falls decreasing the probability of employee injury or illness.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) Final Touch Construction, LLC., on or about June 18th, 2019, at the location of 2363/2365 Manchester Ln., Avon, OH, 44011: The employee tasked with site maintenance including but not limited to picking up litter, cigarette butts, and other materials, which placed him below active roofing work on the duplex residential structure, was not protected from potential falling objects through the use of a protective helmet.
