29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On or about 6/19/19 at a residential new build located at 6 Tranquility Lane, Orchard Park, New York; employees were framing and sheathing a 2 story house. An employee was moving materials while on a porch roof with an eave height of approximately 12 feet. There were no fall protection measures in place. b) On or about 6/19/19 at a residential new build located at 6 Tranquility Lane, Orchard Park, New York; employees were framing and sheathing a 2 story house. There were no guard rails for the second floor windows exposing employee to a fall height of approximately 12 feet. c) On or about 6/19/19 at a residential new build located at 6 Tranquility Lane, Orchard Park, New York; employees framing and sheathing a 2 story house. There was an incomplete guardrail around the stairway on the second floor exposing employee to falls of approximately 10 feet. NO ABATEMENT CERTIFICATION REQUIRED

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about 6/19/19 at a residential construction site located at 6 Tranquility Lane, Orchard Park, New York; employees were framing a house from a job built work platform attached to the forks of a rough terrain forklift. The use of a personnel platform was not approved for use by the forklift manufacturer, exposing employees to a fall hazards. NO ABATEMENT CERTIFICATION REQUIRED
