OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    An employee was exposed to struck-by and pinch point hazards standing inside a bucket of a Kobelco Excavator Model# 80CS while being lowered into an excavation greater than 7 feet in depth preparing for new install of a 4 inch water main pit for a fire suppression.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    On June 19, 2019, located on the north side of a commercial structure, an employee was exposed to cave-in hazards while working inside an excavation greater than 7 feet in depth that had not been trained on the applicable procedures or regulation to minimize those hazards associated with trenching and excavation such as but not limited to cave-in protection, and means of egress.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.    On June 19, 2019, an employee was working in an unprotected excavation in which water was accumulating and that no adequate protected system was installed or water removing system, or safety harness and lifeline used to protect the employee from cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.    On June 19, 2019, located on the north side of a commercial structure, an employee was exposed to cave-in hazards as there were no inspections conducted by a competent person to evaluate for the need of a protective system, suitable means of access or egress located within 25' of the excavation, and adequate precautions taken to protect against the hazards posed by water accumulation.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    On June 19, 2019, located on the north side of a commercial structure, an employee was observed working in an excavation that was greater than 7' in depth that had no suitable means of access or egress located within 25' of the work area within the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.    On June 19, 2019, located off of a two-lane roadway, an employee working in an excavation greater than 7' in depth without adequate protection against cave-ins, in that the walls of the excavation were not properly sloped shored, benched or otherwise adequately protected against collapse.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
