29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary. On or about 18 June 2019, and at times prior thereto, two workers were performing work inside an excavation in which the spoil pile was not at least 2 feet back from the edge, exposing the workers to the hazard of being struck by falling excavated material.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about 18 June 2019, and at times prior thereto, two workers were performing work in an excavation that did not have adequate cave-in protection, exposing the workers to the hazard of a cave-in and engulfment.
