29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On or about June 21, 2019, at the construction site located at the intersection of St. Paul Drive / Fairview Court in Slinger WI, an employee was performing work in an approximately 10 3/10 foot deep excavation without adequate cave-in protection, thereby exposing employees to a struck-by / crushing hazard. Heartland Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1369069, citation number 1, item number 1 and was affirmed as a final order on 5/9/19, with respect to a workplace located at HWY I, Cedarburg, WI53086. Heartland Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1324734, citation number 1, item number 2 and was affirmed as a final order on 8/22/18, with respect to a workplace located at HWY 60 / Charolais Drive, Slinger WI 53086.
