29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. On or about June 21, 2019, located at the Rover Anomaly Project off of Beaver Dam Road in Bowerston, Ohio, employees were working inside of a trench shield to perform an anomaly repair on a 42 inch gas line. The protective system had plywood installed on one end which did not adequately protect the employees from cave-in hazards.

29 CFR 1926.652(a)(2): Protective systems shall have the capacity to resist without failure all loads that are intended or could reasonably be expected to be applied or transmitted to the system. a. On or about June 21, 2019, located at the Rover Anomaly Project off of Beaver Dam Road in Bowerston, Ohio, employees were working inside of a trench shield to perform an anomaly repair on a 42 inch gas line. Plywood was used as part of the trench shield's protective system which did not protect the employees from cave-in hazards.

29 CFR 1926.652(c)(3)(iii): At least one copy of the tabulated data, which identifies the registered professional engineer who approved the data, shall be maintained at the jobsite during construction of the protective system. After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request. a. On or about June 21, 2019, located at the Rover Anomaly Project off of Beaver Dam Road in Bowerston, Ohio, employees were working inside of a trench shield to perform an anomaly repair on a 42 inch gas line. The employer did not maintain tabulated data at the jobsite for the protective systems while being constructed nor did the employer make available a copy of the data to the Secretary upon request.
