29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a. On or about June 21, 2019 the employer did not assure the portable Werner Aluminum articulating ladder used to access the roof truss framing extended three feet above the roof surface being accessed exposing employees to an 11'-3" fall hazard.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  a. On or about June 21, 2019 the employer did not assure the 20 foot portable Werner brand aluminum articulating ladder was used at an angle such than the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length. The foot of the ladder was measured at 8 feet from the wall the wall height was determined to be 11 feet- 3 inches from the ground.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a. On or about June 21, 2019 employees were installing roof sheathing, hurricane straps and truss blocking using pneumatic nail guns, and were not wearing eye protection exposing them to flying debris or impact to the eyes.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on June 21, 2019, when employees are installing roof trusses, on a residential dwelling at 6242 West Fallsgrove Lane, Port Orange, FL 32128, without fall protection and are exposed to falls of approximately 11 feet 3 inches to the ground below.      Olveras Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 (B)(13) which was contained in OSHA inspection number 1309362, citation number 1, item number 1 and was affirmed as a final order on June 11, 2018, with respect to a workplace located at 129 Cerise Court Lot #279  Ormond Beach, FL 32174
