29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  (a) On or about June 24, 2019, the employer, 2 Hail, Inc. dba: A to Z roofing, did not conduct frequent and regular inspections on the job site that would have identified the hazards associated with employees working at heights great than 6 feet and had not implemented effective and efficient fall protection, in that 11 sub-contractor employees of JC Roofing Specialist and 3 employees from A to Z Roofing who were removing and installing shingles on residential homes and were not utilizing a fall protection system.  Employees were working at heights of 11.9 feet on the first level of the residential homes and at 21.9 feet on the second level of the residential homes located at the located at the Terrace at Columbine on 7520A, 7520B, 7520C, 7520D, and 7520E West Coal Mine Ave, Littleton, CO. This condition exposed the 14 employees to a fall of approximately 11.9 to 21.9 feet.    Abatement Note:  OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)  On or about June 24, 2019, the employer, 2 Hail, Inc. dba A to Z Roofing, did not ensure that employees were protected from injury, in that 11 sub-contractor employees of JC Roofing Specialist and 3 employees from A to Z Roofing who were removing and installing shingles on residential homes and were not utilizing a fall protection system.  The residential homes, located at the located at the Terrace at Columbine on 7520A, 7520B, 7520C, 7520D, and 7520E West Coal Mine Ave, Littleton, CO, had a roof height of approximately 11.9 feet for the first level and 21.9 feet for the second level.  This condition exposed the 14 employees to a fall of approximately 11.9 to 21.9 feet.    The employer, A to Z Roofing & Gutters was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13), which was contained in OSHA inspection number 1111829 , citation number 1, item number 2, and was affirmed as a final order on June 21, 2016, with respect to a workplace located at 1415 East 9th Ave, Denver, CO 80218.
