29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  (a) On or about June 24, 2019, this controlling employer did not ensure effective safety inspections of the workplace, including, but not limited to, subcontractor roofing work on new two story residential units.  Hazards including falls from the roof and unsafe ladder use were not identified.  NOTE: Abatement certification is NOT required for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) Employees of a subcontractor engaged in roofing a new two story residential unit were not using fall protection and exposed to falls of 10.4 feet at the eave of the first level to 23 feet at the peak of the second level. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Employees of a subcontractor engaged in roofing a new two story residential unit were using a ladder to access the 2nd story 21 feet above the ground.  The ladder extended only approximately 1 foot above the eave.   NOTE: Abatement certification AND supporting documentation ARE required for this item.
