OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about and at times prior to June 17, 2019, employee working as Slinger was exposed to the hazards of high ambient temperature and working in direct sunlight, which produced Wet Bulb Globe Temperatures (WBGT) of 85.3 degrees Fahrenheit (Heat Index of 95 degrees Fahrenheit), while performing garbage collection duties, including but not limited to lifting of 25 to 50 pounds totes. Such exposures may lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, and heat stroke.
