OSH ACT of 1970 Section (5)(a)(1): : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall and struck-by hazards: a) On or about June 11, 2019 - New Second Floor Box Room, employees and contractors were exposed to falls and struck-by hazards when the concrete thickness of the floor was changed from 6 inches, called for in the stamped drawing by the professional engineer, to approximately 9 inches thick without proper engineering evaluation of the existing structural framing. This reduced the allowable Live Load of the modified second floor and this may have contributed to the collapse of the second floor. The design change neither had approval from the professional engineer who stamped the design drawings nor was reviewed and stamped by another professional engineer. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure employees are following safe work practices such as informing the appropriate level manager of any structural modification(s) and complying with the Alabama State Board of Registration for Professional Engineers and Land Surveyors, Administrative Code, Chapter 33-X-11-03, Seals, Page 11-3, paragraph (5), and allow a Professional Engineer to evaluate, approve, provide the Professional Engineers stamp and signature on the drawings, then communicate the approved modification of all parties involved in the construction.
