29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   On or about June 25, 2019, employees were exposed to respiratory stressors associated with being required to wear respirators such as, but not limited to, Pureflo PF65 Power-Air Purifying Respirators while operating furnaces and performing other job duty requirements and the employer did not provide medical evaluations to employees prior to respirator use.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1024(e)(1)(i): The employer did not establish and maintain a beryllium work area wherever the criteria for a "beryllium work area" set forth in paragraph (b) are met:   On or about June 25, 2019, employees were exposed to beryllium hazards while being required to perform task such as, but not limited to, maintenance tasks, and the melting and storing of beryllium parts. These processes involve material that contains at least 1% beryllium by weight and employees are exposed through airborne contamination by melting and/or dermal contact during the handling of the material.  The employer did not establish and maintain a designated beryllium work area wherever needed onsite.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1024(k)(3)(ii): The employer must ensure that the employee is offered a medical examination that includes 1910.1024(k)(3)(ii)(A) through 1910.1024(k)(3)(II)(G).  On or about June 25, 2019, employees were exposed to beryllium hazards while being required to perform tasks such as, but not limited to, maintenancing, melting and the storing of beryllium parts. The employer did not ensure employees were offered examinations that may include a medical and work history with airborne and dermal exposures to beryllium, physical examination with emphasis on the respiratory system, physical examination for skin rashes, pulmonary function tests, low dose computed tomography (LDCT) scan when recommended, and any other tests deemed appropriate.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.   On or about June 25, 2019, employees were required to produce final products such as ingots for the manufacturing of items such as, but not limited to, dental alloys, stelite welding rods, jewelry, and aerospace products.  The metal alloy ingots contain beryllium and the employer did not ensure safety data sheets were developed for each hazardous product manufactured onsite.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
