29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part.  A) Edgar Rodriguez on or about June 25, 2019 at the address of 3414 Dorr Street, Toledo, Ohio: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  A) Edgar Rodriguez on or about June 25, 2019 at the address of 3414 Dorr Street, Toledo, OH: The employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations. The employees did not recognize the hazards associated with working from an elevated location (18 feet) without the benefit of fall protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  A) Edgar Rodriguez on or about June 25, 2019 at the address of 3414 Dorr Street, Toledo, OH: The employer did not ensure employees were protected from falls while tearing off old roofing materials (shingles) from a residential type structure.  The employees were exposed to a potential 18 foot fall to the level below.
