29 CFR 1910.1030(c)(1)(iv): The Exposure Control Plan was not reviewed and updated when necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure:    a)  In the Facility, on or about June 25, 2019 - The employer did not update the facility's written Exposure Control Plan to reflect the updated CDC Guidelines regarding the hepatitis B vaccination series and subsequent testing for antibody to Hepatitis B surface antigen for employees who receive the hepatitis B vaccination series.        ABATEMENT NOTE:  The Centers for Disease Control (CDC) is the U.S. Public Health Service agency responsible for issuing guidelines and making recommendations regarding infectious agents.  OSHA requires employers follow the CDC guidelines current at the time of the evaluation or procedure.  Currently, the CDC guideline regarding Hepatitis B (HBV) is "Updated U.S. Public Health Service Guidelines for the Management of Occupational Exposures to HBV, HCV, and HIV and Recommendations for Postexposure Prophylaxis" published in Morbidity and Mortality Weekly Report Vol. 50, No. RR-11, June 29, 2001.  It states that employees who have ongoing contact with patients or blood and are at ongoing risk for percutaneous injuries are to be tested for antibody to Hepatitis B surface antigen, one to two months after the completion of the three-dose vaccination series.  Employees who do not respond to the primary vaccination series must be revaccination with a second three-dose vaccine series or be evaluated to determine if they are HBsAg-positive.  Revaccination persons should be retested at the completion of the second vaccine series.  Non-responders to vaccination who are HBsAg-negative should be considered susceptible to HBV infection and should be counseled regarding precautions to prevent HBV infection.

29 CFR 1910.1030(c)(2)(i): The employer having employees with occupational exposure did not prepare an exposure determination:      a)  In the Facility, on or about June 25, 2019 - The employer's written Exposure Control Plan did not include an exposure determination which includes a list of job classifications in which employees with occupational exposure to blood and/or bloodborne pathogens are defined.      ABATEMENT NOTE:      The exposure determination shall include the following:    1.  A list of all job classification in which all employees in those job classifications have occupational exposure;    2.  A list of job classifications in which some employees have occupational exposure;  and    3.  A list of all tasks and procedures or groups of closely related task and procedures in which occupational exposure occurs and that are performed by employees.
