29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:  Employees were exposed to struck-by and fall hazards.  At the jobsite located at 5407 Falmouth Rd. Fairway, KS:  Employees engaged in roofing activities were exposed to struck-by and fall hazards while working without hard hats while under other employees and working from heights greater than 6 feet above a lower level.  Employees were exposed in that the employer had not developed and maintained a written comprehensive safety and health program which addressed these and other hazards.

Fairway, KS:  An employee engaged in ground hand activities working below employees engaged in roofing activities was exposed to struck-by hazards in that head protection was not provided.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  Employees were exposed to struck-by hazards.  At the jobsite located at 5407 Falmouth Rd. Fairway, KS:  Employees engaged in roofing activities using pneumatic nailers were exposed to struck-by hazards in that eye protection was not provided.  Osualdo Zavala Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR1926.102(a)(1), which was contained in OSHA inspection number 1375580, citation number 1, item number 1 and was affirmed as a final order on 04/02/2019, with respect to a workplace located at 1784 Homestead Ave. Liberty, Missouri.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  Employees were exposed to fall hazards.  At the jobsite located at 5407 Falmouth Rd. Fairway, KS:  Employees engaged in residential roofing activities, walking and working on a 8:12 pitch roof, were exposed to fall hazards of greater than approximately 8 feet 10 inches from the eave of the residence to the ground below in that fall protection was not utilized.   Osualdo Zavala Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR1926.501(b)(13), which was contained in OSHA inspection number 1375580, citation number 1, item number 2 and was affirmed as a final order on 04/02/2019, with respect to a workplace located at 1784 Homestead Ave. Liberty, Missouri.
