29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Site- Employees working from a JLG 600S aerial lift were not protected from an ejection and fall hazard where lanyards capable of connecting the employees to the basket of the aerial lift were not available at the site.

29 CFR 1926.1053(a)(1)(ii): Each portable ladder that is not self-supporting was not capable of supporting at least four times the maximum intended load. except that each extra-heavy-duty type 1A metal or plastic ladders shall sustain at least 3.3 times the maximum intended load. Ladders built and tested in conformance with the applicable provisions of appendix A will be deemed to meet this requirement.  Lower Roof- An employee working from the lower roof was not protected from a fall hazard while accessing the roof where the portable ladder used for access was two frames of a material hoist system that are not meant for climbing and was not rated to support 4 times the intended load.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    Lower Roof- An employee working from the lower roof was not protected from a fall hazard while accessing the roof where the portable ladder used for access was not long enough to extend three feet above the landing surface. The ladder was not secured at the top and a grasping device was not provided.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  Site- Employees working from the ground were not protected from over head struck by hazards where head protection was not required to be worn.  The employer routinely fails to assure effective protection against overhead struck by hazards as required by the standard, as demonstrated on June 26, 2019, when employees working from the ground as they performed roofing activities were exposed to an overhead struck by hazard where head protection was not worn at 18 Harbor Avenue, Nashua, New Hampshire.  Franzoso General Contractor Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1359255, citation number 1, item number 1, and was affirmed as a final order on February 19, 2019 with respect to a workplace located at 61-67 Eastmeadow Way, Manchester, NH 03109.  Franzoso General Contractor Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1355046, citation number 1, item number 1, and was affirmed as a final order on February 12, 2019 with respect to a workplace located at 25-31 Eastmeadow Way, Manchester, NH 03109.

The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on June 26, 2019, when employees working from the roof as they performed roofing activities were exposed to a fall of approximately 35 feet where personal fall arrest equipment was not utilized at 18 Harbor Avenue, Nashua, New Hampshire.  Franzoso General Contractor Inc. was previously cited for a willful violation of this occupational safety and health standard which was contained in OSHA inspection number 1359255, citation number 2, item number 1, and was affirmed as a final order on February 19, 2019 with respect to a workplace located at 61-67 Eastmeadow Way, Manchester, NH 03109.
