29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    (a)  A Clark Model C500Y 135 D Diesel powered forklift located in the yard was equipped with 6 foot long fork extensions that were not approved for use by the manufacturer and placed on the attachment section of the nameplate.    (b)  A Clark Model CGP25 LP powered forklift located in the back yard was equipped with approximately 80 inch long fork extensions that were not approved for use by the manufacturer and placed on the attachment section of the nameplate.

29 CFR 1910.178(o)(1): Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered.    On or about June 19, 2019, employees utilizing a Clark Model CGP25 LP powered forklift with 80 inch fork extensions to handle an electrical cabinet that was approximately 1.5 feet x 1.5 feet x 6.5 feet tall.  The load was unstable and not secured to the forks leading it to fall from the forks crushing an employee trying to stabilize it.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    A Summit Machine Tool Manufacturing Corp. Model No. 10 x 1/4 hydraulic press brake did not have any form of machine guarding to prevent employees from accessing the point of operation between the dies during the operating cycle.

29 CFR 1910.1026(d)(2)(i): The employer shall perform initial monitoring to determine the 8-hour TWA exposure for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area. Where an employer does representative sampling instead of sampling all employees in order to meet this requirement, the employer shall sample the employee(s) expected to have the highest chromium (VI) exposures.    The employer did not perform initial monitoring to determine employee exposure to chromium (VI) when employees were MIG welding on stainless steel.
