Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by cut-off machinery and/or other objects: a) On or about June 27, 2019, an employee was exposed to the hazard of contacting a rotating cutting blade, being struck-by thrown objects, and/or reactive forces, including kickback, where a circular toothed saw blade was provided and used with a Husqvarna K770 cut-off machine to cut wood. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about June 27, 2019, the employer did not instruct or provide instruction to employees in the recognition and avoidance of unsafe conditions and the regulations applicable to their work environment to control or minimize the hazards associated with operating a cut-off machine. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
