(a)AAA Plumbing at 3827 Kyle Street, Rapid City, SD 57701: On or about and at times prior to May 27, 2019, the employer did not ensure employees were protected from cave-in hazards in that, an employee performed work in an unprotected excavation at an approximate depth of 7 feet when locating and shutting off damaged water lines. This condition exposed an employee to cave-in hazards.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: (a)AAA Plumbing at 3827 Kyle Street, Rapid City, SD 57701: On or about and at times prior to May 27, 2019, the employer did not ensure employees were protected from cave-in hazards in that, employees performed work in an unprotected excavation at an approximate depth of 7 feet when locating and shutting off damaged water lines. Due to environmental factors and the damaged water lines, this work was performed when accumulated water was present in the excavation. This condition exposed employees to cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)AAA Plumbing at 3827 Kyle Street, Rapid City, SD 57701: On or about and at times prior to May 27, 2019, the employer did not ensure employees were protected from cave-in hazards in that, competent person inspections were not performed. Daily inspections would have also identified that employees were exposed to fire, explosion and/or asphyxiation hazards in that, an unsupported sidewalk panel fell into the excavation striking a high pressure gas line. At the time of the inspection, another sidewalk panel was observed overhanging the excavation above the same high pressure gas line. These conditions exposed employees to cave-in hazards and fire and explosion hazards.
