29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket:     (a) Telecommunications Tower, 328 Stafford Forge Rd., West Creek, NJ; on or about June 28, 2019, the employer did not ensure employees were using a safe means of egress from the elevated platform of a JLG 1850J aerial lift.  Employees were climbing the rails of the lift basket to access work areas on a 150 foot tall monopole telecommunication tower, exposing them to fall hazards.        NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely:     (a) Telecommunications Tower, 328 Stafford Forge Rd., West Creek, NJ; on or about June 28, 2019, Rise & Rise Wireless Inc. employees were using the T-bar antenna supports of a 150 foot tall telecommunication tower as their walking/working surface.  The employer had not assessed the strength and structural integrity of the surfaces to ensure that they were capable of supporting employees safely.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.     (a) Telecommunications Tower, 328 Stafford Forge Rd., West Creek, NJ; on or about June 28, 2019, Rise & Rise Wireless Inc. employees were installing upgraded equipment at the top of a 150 foot tall monopole telecommunication tower.   The employer did not ensure that employees were utilizing fall protection at all times while walking/working from the T-bar antenna supports on the tower.  As a result an 18 year old employee fell from the tower, 145 feet to his death.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person.    (a) Telecommunications Tower, 328 Stafford Forge Rd., West Creek, NJ; on or about June 28, 2019, Rise & Rise Wireless Inc. employees were installing upgraded equipment at the top of a 150 foot tall monopole telecommunication tower.   Employees were using the T-bar antenna supports of the tower as their walking/working surface.  An employee was using various tie off locations as anchorage for personal fall arrest systems without the use of a proper anchor strap.  The employee was not properly supervised by a qualified person regarding appropriate anchor points during his work activity, exposing him to potential fall hazards.       NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

An employee was walking/working on and from the T-bar antenna supports of the tower.  The employer did not ensure that this employee had been appropriately trained to recognize the specific fall hazards associated with climbing and working on communication towers and the procedures to be followed in order to minimize these hazards.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
