29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Martinez Construction, LLC at 3301 West 51st Street, Sioux Falls, SD 57106:  On or about and at times prior to June 28, 2019, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. This condition exposed employees to fall hazards related to the roof and ladders and eye injuries.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. This condition exposed employees to fall hazards, ladder hazards and eye hazards.

29 CFR 1926.102(a)(1): The employer did not ensure each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)Martinez Construction LLC at 3301 West 51st Street, Sioux Falls, SD 57106: On or about and at times prior to June 28, 2019, the exposing employer did not ensure that employees were protected from projectile hazards. Employees were using pneumatic air guns to install roofing material without eye protection. This condition exposed employees to eye injuries.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a)Martinez Construction, LLC at 3301 West 51st Street, Sioux Falls, SD 57106: On or about and at times prior to June 28, 2019, the exposing employer did not ensure employees were protected from fall hazards. Employees were engaged in re-roofing activities on a multi-family residence without the use of a fall protection system. This condition exposed employees to a fall hazards between 10 and 30 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  (a)Martinez Construction, LLC at 3301 West 51st Street, Sioux Falls, SD 57106:  On or about and at times prior to June 28, 2019, the exposing employer did not ensure that each employee engaged in roofing operations on a commercial multi-family residence, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations between 10 and 30 feet.    Abatement Note:  The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize fall hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Martinez Construction, LLC at 3301 West 51st Street, Sioux Falls, SD 57106:  On or about and at times prior to June 28, 2019, the exposing employer did not ensure that each employee was protected from falls in that, four employees were utilizing ladders to gain access to the roof that was positioned on a third floor balcony to the roof and not extended at least three feet above the upper landing surface. This condition exposed employees to a fall hazard.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The condition exposed employees to the hazard of falling from elevations over 10 feet.
