There were hazards associated with the Biro vertical band saw in the Meat Department. An amputation injury was sustained by the victim while operating this piece of equipment.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about 07/01/2019, Schnuck Markets, the Dardenne Prairie store, located at 3029 State Highway K, OFallon, MO, butcher(s) were exposed to hazards such as those created by point of operation and rotating parts. The Biro vertical band saw for cutting meat did not have its blade guard properly adjusted. During interviews and conversations, no one knew of the required adjustment height for the blade guard.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): On or about 07/01/2019, Schnuck Markets, the Dardenne Prairie store, located at 3029 State Highway K, OFallon, MO, had not established a Hazard Communication Program complete with all the required corresponding Safety Data Sheets (SDS). The employer did have Material Safety Data Sheets (MSDS) for various products/materials. The employer had not converted everything to Safety Data Sheets. There were such products as: 1) Aaron Industries, Inc., 70% ISOPROPYL ALCOHOL; 2) Buckeye International, Inc., ANTIMICROBIAL FOAMING SOAP; and 3) AQUATOC, Air freshening product.
