29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) On or about 6/4/19 at a residential new build located at Aspen Lane Lot #31, Orchard Park, New York; employees framing and sheathing a 2 story of house were walking on the top plate of the wall. There were no fall protection measures in place.  b) On or about 6/4/19 at a residential new build located at 2284 Agassiz Lane, Lakeview, New York; employees framing and sheathing a 2 story of house were walking on the top plate of the wall. There were no fall protection measures in place.  ABATEMENT CERTIFICATION REQUIRED  The D.B.J. Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1073532, citation number 1, item number 1 and was affirmed as a final order on 08/21/15, with respect to a workplace located at 13 Margum Lane, Lancaster, New York.  The D.B.J. Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1060665, citation number 2, item number 1 and was affirmed as a final order on 06/3/15, with respect to a workplace located at 29 Newberry Lane, Lancaster, New York.  The D.B.J. Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1021794, citation number 1, item number 1 and was affirmed as a final order on 02/25/15, with respect to a workplace located at 41-43 Brocton Lane, Lancaster, New York.  The D.B.J. Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1012816, citation number 1, item number 1 and was affirmed as a final order on 05/11/15, with respect to a workplace located at 35 Riley Meadow, Orchard Park, New York.
