29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section:   (a)  On or about June 26th, 2019, and at times prior to that date, for the employees who were exposed to a fall in excess of 16 feet while installing insulation from a man basket that was attached to a telehandler that did not have a railing or personal fall protection equipment while working next to an unprotected edge, Skyjack Herculift (VR1056D), in the vicinity of First Avenue West & Sukust Street in West Fargo, North Dakota.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:   (a) On or about June 26th, 2019 and at times prior to that date, for the employees exposed to electrical shock hazards from an electrical extension cord attached for supply to a construction site where strain relief has been damaged in the vicinity of First Avenue West & Sukust Street in West Fargo, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1365187 , Citation  1, Item 1b, and was affirmed as a final order on May 9, 2019,  with respect to a workplace located at 4235 28th Avenue South in Fargo, North Dakota.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design  Or in the alternative:  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:   (a)  On or about June 26th, 2019, and at times prior to that date, for the employees who were exposed to a fall in excess of 16 feet while installing insulation from a 14 foot man basket that was attached to a telehandler that was used beyond the allowable wheelbase and not secured to the forks of the all terrain forklift, Caterpillar TH-83(TL943), in the vicinity of First Avenue West & Sukust Street in West Fargo, North Dakota  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1365187, Citation 1, Item 2a , and was affirmed as a final order on May 9, 2019,   with respect to a workplace located at 4235 28th Avenue South in Fargo, North Dakota.
