29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 06/27/19, on the dormer roof above the front steps of a house at 700 Lafayette Ave., Buffalo, NY: An employee was exposed to a fall of approx. 12 ft. while at the west edge of the dormer roof directing another employee who was doing painting work from a ladder. No fall protection system was being utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(a)(1)(ii): Each portable ladder that is not self-supporting was not capable of supporting at least four times the maximum intended load, except that each extra-heavy-duty type 1A metal or plastic ladders shall sustain at least 3.3 times the maximum intended load. The ability of a ladder to sustain the loads indicated in this paragraph shall be determined by applying or transmitting the requisite load to the ladder in a downward vertical direction when the ladder is placed at an angle of 75 1/2 degrees from the horizontal. Ladders built and tested in conformance with the applicable provisions of appendix A will be deemed to meet this requirement: a) On or about 06/27/19, at a house located at 700 Lafayette Ave., Buffalo, NY: An employee was doing painting work on the exterior of the house from a non self-supporting ladder set up on the front lawn just west of the dormer above the front steps of the house. The employee was exposed to a fall of approx. 8 ft. because the ladder was set up at an angle of 56 degrees from the horizontal. At this angle, the ladder was not capable of supporting four times the maximum intended load. An acceptable angle would be approx. 75.5 degrees. NO ABATEMENT CERTIFICATION REQUIRED
