29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   (a) AMG Construction, LLC on or about July 1, 2019 at the address of 4087 Fleetfoot Rd. Coldwater, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. Untrained forklift operators are hazardous to other employees working in the direct vicinity, such as not ensuring attachments are secured to the forks and overloading by attaching platforms that are too large for the lift, increasing the likelihood of tipping and rollovers.

AMG Construction, LLC, on or about July 3, 2019 at the address of 4087 Fleetfoot Rd. Coldwater, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as preventing falls from heights on the worksite.

29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person:   (a) AMG Construction, LLC on or about July 1, 2019, at the address of 4087 Fleetfoot Rd. Coldwater, OH: The employer did not ensure the scaffolding platform attachment (Fabricated steel mesh and frame) used to elevate employees via forklift, was designed and loaded on to the fork lift by a qualified person. Employees installing top plates at the top of the structure in this condition were exposed to a fall of approximately 16 feet.

Coldwater, OH: The employer did not ensure employees were protected from falls while working from a job made scaffold platform.  The employee was exposed to a 16ft fall to the level below while installing top plates to the top of the residential structure.

Coldwater, OH: The employer did not ensure employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, guardrail systems or alternative measures while installing top plates to the top of a residential structure. Employees were unable to identify fall hazards on the job site, exposing them to fall hazards of up to 16ft.
