29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On July 1, 2019, located at a residential structure, there were no frequent and regular inspections being performed by a competent person in that employees were: using a portable extension ladder that had a defective rope and pulley system due to a missing rope; using a portable extension ladder on a surface that was not level; using a portable extension ladder that was positioned on a sloping hillside; and using a portable extension ladder that was not secured to prevent accidental displacement.

29 CFR 1926.1053(b)(6): (Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated:) Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement.    On July 1, 2019, located at a north exterior wall of a residential structure, an employee performing painting work from a 24 foot portable extension ladder was exposed to potential fall heights of 16'5" above ground level. The portable extension ladder was positioned on a sloping hillside containing tall grass, a 10% downward grade and not secured to prevent accidental displacement.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.    On July 1, 2019, located at a north exterior wall of a residential structure, employees were positioning a 24 foot portable extension ladder with a defective rope and pulley system in that the ladder rope was missing, causing employees to raise the long ladder in an extended position and exposing employees to struck-by hazards.

29 CFR 1926.1060(a)(1)(iii): (The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.)(The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:)   The proper construction, use, placement, and care in handling of all stairways and ladders;    The employer did not ensure training on the proper construction, use, placement and care in handling of ladders was provided by a competent person for employees performing painting work from portable ladders.
