The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On July 1, 2019, an employee was operating a Skyjack SJ843 TH Telescopic Forklift that had not received training required by this subpart.

29 CFR 1926.502(a)(2): ("General.") Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  (a) On July 1, 2019, located at a commercial roof structure, employees were not provided with fall protection equipment before working at the unprotected side or edge of a steel girder and were exposed to potential fall heights of 14' (lower girder) and 17'7" (upper girder) above ground level.  (b) On July 1, 2019, located at a commercial roof structure, employees were not provided with fall protection equipment before working at the unprotected side or edge of a ladder jack scaffold and were exposed to potential fall heights of 12'4" above ground level.

29 CFR 1926.503(a)(1): ("Training Program.") The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  (a) The employer did not provide a training program for employees performing framing work from a steel girder while not utilizing a fall protection system and exposed to potential fall heights of 14' (lower girder) and 17'7" (upper girder) above ground level.  (b) The employer did not provide a training program for employees performing framing work from a ladder jack scaffold while not utilizing a fall protection system and exposed to potential fall heights of 12'4" above ground level.

29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On July 1, 2019, located at a commercial jobsite, there were no frequent and regular inspections being performed by a competent person in that employees were: working underneath overhead hazards (ladder jack scaffold) without head protection; performing framing work from a ladder jack scaffold platform with one foot on the ladder jack platform and the other foot on a porch overhang; using a ladder jack that did not have platform ends extending at least 6 inches over the end supports; using the ladder supports of a ladder jack scaffold as platform access while the platform brackets did not allow for safe transition from ladder to platform; using a ladder jack scaffold that had been placed on uneven ground and not properly adjusted, causing the ladder jack platform to tilt on one side; standing on a steel girder without using a fall protection system at potential fall heights of 14 feet and 17'7" above ground level; working from a ladder jack scaffold platform without a fall protection system at potential fall heights of 12'4" above ground level; using an extension cord with the ground plug removed; and using an extension cord that had frayed wiring.  V & E Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1313932, citation number 1, item number 1 and was affirmed as a final order on 7/31/2018, with respect to a workplace located at 4949 Boxwood Dr., Mason OH 45040.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) On July 1, 2019, located at a commercial jobsite, employees were performing framing work while standing on top of a steel girder with unprotected sides and edges while not utilizing a fall protection system and exposed to potential fall heights of 14' (lower girder) and 17'7" (upper girder) above ground level.  (b) On July 1, 2019, located at a commercial jobsite, employees were performing framing work from a ladder jack scaffold platform with unprotected sides and edges while not utilizing a fall protection system and exposed to potential fall heights of 12'4" above ground level.  V & E Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1313558, citation number 1, item number 1 and was affirmed as a final order on 7/31/2018, with respect to a workplace located at 5310 Stony Run Court, Hamilton OH 45011.  V & E Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1313932, citation number 1, item number 2 and was affirmed as a final order on 7/31/2018, with respect to a workplace located at 4949 Boxwood Dr., Mason OH 45040.
