29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use did not present a health hazard to the user:    a) Mixing Area: The employer did not establish and implement a written respiratory program for employees that voluntarily wore a North 7700 Half Mask Respirator to mix and package chemicals such as, but not limited to Sodium Hydroxide and Potassium Hydroxide, on or about 7/3/19.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Mixing Area: The employer did not provide a medical evaluation to employees that wore a North 7700 half mask respirator to mix powdered chemicals, such as, but not limited to Sodium Hydroxide and Potassium Hydroxide to make mild detergents and caustic cleaners, on or about 7/3/19.
