29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  A hearing conservation program was not established when employees, some stackers and offbearers, were exposed to noise levels exceeding 85 dBA (50% dose) at an 8-hour time weighted average, as determined by noise monitoring conducted on July 2, 2019.  Levels were measured at: 92.8, 90.1, 89.7 dBA.  Hearing conservation requires providing hearing protection and requiring its use at least before an audiogram is provided, and training on medical consequences of noise exposure, and the correct use of hearing protection.  Abatement documentation is required for this violation.

29 CFR 1910.95(i)(2)(ii)(A): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater and has not yet had a baseline audiogram established pursuant to 29 CFR 1910.95(g)(5)(ii):  Hearing protection was not required to be worn by employees exposed to noise levels exceeding the action level (85 dBA).  Employees had not been provided hearing tests.   Abatement documentation is required for this violation.

29 CFR 1910.136(a): The employer did not ensure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects, or objects piercing the sole:  Protective footwear was not required by stackers and offbearers.  An injury on 6-25-19 occurred to a stacker resulting in amputation of toes.  Abatement documentation is required for this violation.
