29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located at 7329 Whimbrel Lane, Delaware, Ohio: On or about July 08, 2019, the employer failed to ensure that employees, who worked on the second floor of the a new build residential home, were protected from falling from the unprotected side and edge of the second floor level. The employees were exposed to a fall hazard of 11 feet without any means of fall protection.

Located at 7329 Whimbrel Lane, Delaware, Ohio: On or about July 08, 2019, the employer did not maintain a safety and health program to ensure hazard detection and correction while employees installed OSB sheathing to the second floor of the new build residential home. Employees were unprotected from the second floor of a new build residential home. The employees were exposed to a fall distance was 11 feet to the ground.
