OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards during tree cutting operation: On or about July 6, 2019, an employee working as a ground rigger engaged in a tree cutting operation, was exposed to a struck-by hazard in that the employee was located to near or underneath a limb being cut.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about July 8, 2019, employees operating chainsaws to cut various pieces/sizes of tree limbs were not wearing chaps or other equipment to protect from laceration and amputations hazards.
