29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  ABC Contracting Solutions LLC at 9583 County Road 73 in Roggen, CO 80652: On or before July 3, 2019 the employer did not ensure that employees were provided with the proper personal protective equipment to perform job tasks on the construction site.  Construction workers were not provided with and were not using hard hats when working under areas where falling objects may impact their heads.  This condition exposed employees to the hazard of being struck by falling objects.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) ABC Contracting Solutions LLC at 9583 County Road 73 in Roggen, CO 80652: On or before July 3, 2019 the employer did not ensure that employees were provided with the proper personal protective equipment to perform job tasks on the construction site. Construction workers were not provided protective glasses when working with power tools such as cordless drills. This exposes employees to potential struck by hazards due to flying particles.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration.  Such activities were not performed only by experienced and trained employees selected for such work by the competent person.    a) ABC Contracting Solutions LLC at 9583 County Road 73 in Roggen, CO 80652: On or before July 3, 2019, the employer did not ensure that scaffolds were erected by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection.  An employee of ABC Contracting Solutions connected a wooden pallet to the forks of a JLG Skytrak forklift, and used this pallet to raise himself up to greater than 10 feet high to perform welding operations. The employer did not ensure that a competent person performed an inspection of this pallet scaffold platform before use.  This condition exposed this employee to fall hazards of greater than 10 feet from the raised pallet to the ground.

This condition exposed this employee to fall hazards of greater than 10 feet from the raised pallet to the ground.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  a) ABC Contracting Solutions LLC at 9583 County Road 73 in Roggen, CO 80652: On or before July 3, 2019, the employer did not ensure that employees working in forklifts were trained to operate the lift. The employer did not train and evaluate each operator who is authorized to operate the JLG Skytrak forklift to ensure they were competent to operate the forklift safely. This exposed employees to potential struck by and struck against hazards.  Abatement note:  This section provides that the requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.
