29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. Located at 240 Honeywood Drive N, Galena, Ohio: On or about July 08, 2019, the employer did not maintain a safety and health program to ensure hazard detection, and correction while employees installed framing lumber in between the joist of the second floor level of the new build residential home. The employees were unprotected from in between the joist of the new build residential home. The employees were exposed to a fall distance of 9 feet 11 inches to the concrete ground level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located at 240 Honeywood Drive N, Galena, Ohio: On or about July 08, 2019, the employer failed to ensure that two employees who worked on the second level of a new build residential home were protected from falling off the second floor level. The employees were exposed to a fall hazard of 9 feet 11 inches without any means of fall protection. Within the past five years, the employer had been cited for the same hazards in four different inspections. Alejandro Vasquez Gallegos, was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1324337, citation number 2, item number 1 and was affirmed as a final order on July 24, 2018, with respect to a workplace located at 4351 McAlister Park Drive, Westerville, Ohio.
