29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On July 11, 2019 at 1830 E Pershing Street in Appleton, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the potential for fall from elevation hazards associated with damaged personal fall arrest equipment available for use on site and with employees using an extension ladder to access/egress a roof surface without the side rails extended at three free above the upper landing.

29 CFR 1926.502(d)(21): Personal fall arrest systems shall be inspected prior to each use for wear, damage and other deterioration, and defective components shall be removed from service.  On July 11, 2019 at 1830 E Pershing Street in Appleton, damaged personal fall arrest system equipment was on the worksite available for employee use; two Guardian lifelines were frayed, kinked, and had fiber separation.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab-rail, shall be provided to assist employees in mounting and dismounting the ladder.  On July 11, 2019 at 1830 E Pershing Street in Appleton, employees were using an extension ladder to access/egress a roof edge seventeen and one half feet above surface level without the side rails extended at least three feet above the upper landing.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On July 11, 2019 at 1830 E Pershing Street in Appleton, employees were working on a roof at seventeen and one half feet above surface level without utilizing fall protection equipment.

On July 11, 2019 at 1830 E Pershing Street in Appleton, the employer did not provide required fall protection safety training for employees who did not associate fall from elevation hazards when walking/working on a low slope roof surface with unprotected edges without utilizing fall protection equipment.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On July 11, 2019 at 1830 E Pershing Street in Appleton, the employ, the employer did not provide written employee fall protection safety training certification for employees walking/working from roof surfaces at heights greater than six feet.
