29 CFR 1926.850(a): Prior to permitting employees to start demolition operations, an engineering survey was not made, by a competent person, of the structure to determine the condition of the framing, floors, and walls, and possibility of unplanned collapse of any portion of the structure: a) Worksite, 306 Martin Luther King Blvd, Newark, NJ On or about 7-10-19 a crew of approximately 4 subcontractor employees were manually demolishing floor tile and concrete with sledgehammers and pry bars, on top of and between floor joists of the 3rd floor area, labeled FD-02 and FD-05, when a portion of the floor collapsed seriously injuring one worker. The employer failed to develop a written demolition plan with regard to the operation.

29 CFR 1926.850(b): When employees are required to work within a structure to be demolished which has been damaged by fire, flood, explosion, or other cause, the walls or floor were not shored or braced: a) Worksite, 306 Martin Luther King Blvd, Newark, NJ On or about 7-10-19 a crew of approximately 4 employees were manually demolishing floor tile and concrete with sledgehammers and pry bars, on top of and between floor joists of the 3rd floor area, labeled FD-02 and FD-05, when a portion of the floor collapsed seriously injuring one worker. This floor was damaged by water intrusion for 10 years prior to the beginning of the project and was not supported or braced to prevent collapse during demolition operations.
