29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  a) Worksite, 4 Robins Road, Central Islip, New York - An employee was operating a JLG SkyTrak Telehandler Model No 10054 with a job-made trash box attached to the forks and did not have the manufacturer's written approval; on or about 07/10/2019.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  a) Worksite, 4 Robins Road, Central Islip, New York - An employee was authorized to operate a JLG SkyTrak Telehandler Rough Terrain Forklift Model No. 10054 to load material waste on a job-made trash box attachment and was not trained and certified to operate the powered industrial truck; on or about 07/10/2019  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Worksite, 4 Robins Road, Central Islip, New York - Employees were performing framing work on the third level of the residential building approximately 30ft. above the ground and were not protected from falling; on or about 07/10/2019.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.  Limonejo's Framing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1092846, Citation Number 1, and Item Number 1 and was affirmed as a final order on 11/20/2015, with respect to a workplace located at 161 William Floyd Park, Yaphank, New York.
