Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly: a) This violation was discovered on July 12, 2019, where the employer modified a Raymond forklift (m/n 4450 C35S, s/n 445-15-11986) without the manufacturers prior written approval, exposing employees to PIT accidents.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. Following the work-related hospitalization of an employee that occurred on June 29, 2019, at a jobsite located at 2322 French Settlement Road, Suite 300, Dallas, Texas, the employer did not make an oral report to OSHA within 24 hours after the occurrence.
