29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about July 12 , 2019, and at times prior thereto, employees were using pneumatic nail guns for framing the town homes under construction without eye protection, exposing employees to the hazard of being struck by flying objects.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented: On or about July 12 , 2019, and at times prior thereto, employees were framing the town homes under construction up to approximately 11 feet 8 inches without using fall protection, exposing employees to a fall hazard.
