29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    (a) On or about July 15, 2019, the employer did not ensure that an effective inspection of the excavation and the adjacent areas was conducted by a competent person as needed throughout the shift, in that a protective system was not used while an employee conducted work in a trench that was greater than 5 feet deep, resulting in a collapse burying the employee. 29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (0.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a) On or about July 15, 2019, the employer did not ensure that excavated material was kept at least 2 feet from the edge of a trench that was greater than 5 feet deep. This exposed employees to struck-by and cave-in hazards from excavated material such as soil.  An employee was completely buried from a partial wall collapse resulting in the employee sustaining a broken jaw, a lacerated left ear, and a right arm deep laceration. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a) On or about July 15, 2019, the employer did not ensure that employees conducting work in a trench were fully protected from cave-in hazards, in that work performed to install a new residential water line was done in a trench that was greater than 5 feet deep without a protective system in place. An employee was completely buried from a partial wall collapse resulting in the employee sustaining a broken jaw, a lacerated left ear, and a right arm deep laceration.
