29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the shooting range, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 571.9% (102.5 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) during the 474 minute sampling period. Zero exposure was assumed for the 6 minute period not sampled. This violation was discovered on or about August 16, 2019. b) In the shooting range, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 297.1% (97.8 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) during the 475 minute sampling period. Zero exposure was assumed for the 5 minute period not sampled. This violation was discovered on or about August 16, 2019. c) In the shooting range, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 75.92% (88.0 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 455 minute sampling period. Zero exposure was assumed for the 25 minute period not sampled. This violation was discovered on or about August 7, 2019. d) In the shooting range, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 73.5% (87.7 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 477 minute sampling period. Zero exposure was assumed for the 3 minute period not sampled. This violation was discovered on or about August 16, 2019.
