29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition: a) On or about 07/15/19, at the Tim Horton's Bakery and Café, located on 1250 University Avenue, in Rochester, New York, the employer failed to inspect and maintain in safe condition a lid/cover for a 5-feet grease pit located behind the restaurant. Employees were exposed to fall hazards when they walked around and over the unsecured cover during the task of removing trash and recycling items from the restaurant. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.28(b)(3)(i)(A): The employer did not ensure that each employee on a walking-working surface was protected from falling into any hole or pit that was 4 feet (1.2 m) or more above a lower level by a cover or covers: a) On or about 07/15/19, at the Tim Horton's Bakery and Café, located on 1250 University Avenue, in Rochester, New York, employees were exposed to falling through an unsecured lid/cover for a 5 feet grease pit located behind the restaurant when they walked around and over the lid during the task of removing trash and recycling items from the restaurant. NO ABATEMENT CERTIFICATION REQUIRED
