29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about July 17, 2019; second floor; employees were not wearing the provided eye protection while operating portable tools such as but not limited to nail guns.     No abatement certification or documentation required for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about July 17, 2019, second-floor area; employees were observed walking the top-plate while framing the new residential home without fall protection in place to protect them falling approximately 10-feet to the wooden floor or 23-feet to ground level.   No abatement certification or documentation required for this item.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) On or about July 17, 2019, second-floor area; the side rail on the step-ladder used during the framing process was 2-feet below the surface exposing the employees to a fall of approximately 10-feet to the wooden deck.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:   a) On or about July 17, 2019; second floor; employees were using step-ladders to access the top-plate area that was too short for the application causing the employees to use the top step of the ladder exposing them to a potential fall hazard.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
