29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:  a) On or about July 15, 2019, at the job-site located at 9756-9760 Pembroke Pines, Ruskin, FL, an employee was wood decking fascia while standing on a 6 inch wide wood plank. The wood plank was laying at one side on the top rung of a 6 ft. Fiberglass Single Sided Step Ladder, exposing to a 5 feet fall hazard.

Employees, performing wood roof decking were exposed to a 6 foot fall hazard, in that the top cap of a Fiberglass Single Sided Step Ladder was used to reach the working surface.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) On or about July 15, 2019 at the job-site located at 9756-9760 Pembroke Pines, Ruskin, Florida; employees using pneumatic nail gun to install wood decking on the garage fascia and a circular saw to cut plywood were not wearing eye protection, exposing to struck-by hazards.  DOMINGOS 54 CONSTRUCTION INC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1388590, citation number 1, item number 1 and was affirmed as a final order on 6/24/2019, with respect to a workplace located at 13319 Saw Palm Creek Trail, Lakewood Ranch, FL.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.  At the job site, employees working at elevations of 6 feet or more above ground are not protected from fall hazards by the use of a personal fall arrest system.  The employer fails to assure effective protection against falls as required by the standard, as demonstrated on July 15, 2019, when employees doing roof deck installation work on a 5:12 pitch residential home at 9756-9760 Pembroke Pines, Ruskin, FL 33570 without fall protection were exposed to fall hazards of 17 ft.-4in. from the leading edge of the building.  DOMINGOS 54 CONSTRUCTION INC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1388590, citation number 1, item number 3 and was affirmed as a final order on 6/24/2019, with respect to a workplace located at 13319 Saw Palm Creek Trail, Lakewood Ranch, FL.
