The employer had not initiated and maintained a program to ensure employees were protected from fall hazards when working from a ladder jack scaffold at 10 ft. and performing painting as a part of their work activities on July 18, 2019, at 8185 OH-125, a one-story commercial building.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. On July 18, 2019, at 8185 OH-125, a one-story commercial building, the employer did not have a competent person inspect a ladderjack scaffold erected for painting on the face of the commercial building,for fall protection while working over 10 ft. before the work shift.

29 CFR 1926.451(g)(1): (g) "Fall protection." Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. On July 18, 2019 at 8185 OH-125, a one story commercial building, an employee was standing on the platform of a ladderjack scaffold painting and was exposed to 10' 1" fall hazard without utilizing any fall protection.

29 CFR 1926.454(a)(1): (a) The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: The nature of any electrical hazards, fall hazards and falling object hazards in the work area; The employer did not train employees on the recognition of fall hazards while using a ladderjack scaffold on July 19, 2019 and also the procedures to control or minimize those hazards.
