Employees were using Bosch handheld angle grinders to remove mortar from between the bricks.  The grinder was not equipped with a guard, fully exposing the blade, and thus employees to potential hazards.

29 CFR 1926.1153(c)(1):  For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, and in the alternative, did not properly assesses the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.    a) Collingswood Arms Apartments, Collingwood, NJ:  On or about July 18, 2019, M&N Construction Services Inc. employees were doing pointing type work on the brick fascia of an 8 story apartment building.  Employees were using Bosch handheld angle grinders to remove mortar from between the bricks.  The grinder was not equipped with engineering controls (shroud and vacuum) conforming to Table 1 Section (xi) of this standard creating a  dust cloud potentially containing respirable silica.  Additionally, the employer had not conducted a proper assessment of potential employee exposure to respirable crystalline silica.
