29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure. On or about 7/19/19, employees were exposed to bloodborne pathogens as they performed tasks that included using sharps to administer medication to residents, and cleaning residents as well as their rooms. The employer had not established a Bloodborne Pathogen Exposure Control Plan that cover engineered sharps, Hep B vaccinations, post-exposure procedures, clean up of blood or OPIM (Other Potentially Infectious Materials), training, sharps injury log or any of the required reviews.

29 CFR 1910.1030(d)(4)(iii)(A)(2)(iii): During use, containers for contaminated sharps were not replaced routinely or were allowed to be overfilled: On or about 8/9/19, a sharps container on a medication cart was overfilled on the 2nd floor. An overfilled container exposes the employees discarding sharps to potential needlestick injuries and exposure to bloodborne pathogens.

29 CFR 1910.1030(f)(1)(ii)(A): The employer did not ensure that medical evaluations and procedures including the hepatitis B vaccine and vaccination series, post-exposure evaluation, or follow-up, including prophylaxis, were made available at no cost to the employee: On or about 8/9/19, the employer had not offered or provided the hepatitis B vaccination to employees with potential exposure to bloodborne pathogens. The employer has a policy of sending employees to their personal doctor, on their personal insurance, for these vaccines. The nursing staff are exposed to bloodborne pathogens when providing care to residents on the various resident floors, including but not limited to administering medication with sharps and cleaning residents and their rooms.

29 CFR 1910.1030(g)(2)(vii): The employer's training program did not contain the minimum elements required by 29 CFR 1910.1030(g)(2)(vii)(A) through (g)(2)(vii)(N): On or about 8/9/19, the employer had not provided all employees with occupational exposure to bloodborne pathogens adequate training for employees exposed to bloodborne pathogens while providing care for residents, including but not limited to administering medication and cleaning residents and rooms. The training provided is deficient in the following areas: 1. Providing an accessible copy of the Bloodborne Pathogen Standard and training on it; 2. An explanation and copy of the employer's Exposure Control Plan; 3. An explanation of the methods that will prevent exposure including, engineering controls, work practices and personal protective equipment; 4. Information on the hepatitis B vaccine, including that it will be offered free of charge; 5. What to do in the event of an exposure incident, including initial response, how to report and that post exposure evaluation and follow-up will be made available.
