29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On July 3, 2019 through July 5, 2019, approximately five employees were exposed to potential machine hazards associated with rotating parts, ingoing nip points, and pinch points when engaged in servicing and maintenance work on a Oak Products, Inc. Mechanical Power Perforation Press during plant shutdown. The employer did not ensure that group energy control application steps to control the electrical, pneumatic, and gravity energy sources were implemented prior to allowing employees to enter the pit under the machine to clean the perforations and cutting fluid out. The machine was locked out by a manager who did not secure the key, and the five employees working on the machine did not utilize the group lockout tagout procedure. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.147(f)(3)(i): When servicing and/or maintenance is performed by a crew, craft, department or other group, they shall utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device. On or about July 3, 2019 through July 5, 2019, approximately five employees cleaning the perforations and cutting fluid out from under a pit the Oak Product, Inc. Mechanical Power Press did not utilize a procedure affording employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device.

29 CFR 1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces. The employer did not label a confined space located under the Oak Products, Inc. Mechanical Power Perforation Press pit located in Department 03 of the facility. NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.
