29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) New apartment construction, building #1300 located at 10911 Tara Blvd., Lovejoy, GA, Second floor top plate: On or about 07/17/2019, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees operating these tools at 120 PSI while engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New apartment construction, building #1300 located at 10911 Tara Blvd., Lovejoy, GA, Second floor: On or about 07/17/2019, and at times prior, the employer exposed employees to fall hazards of 11-feet, 7-inches to the lower level, in that fall protection was not provided to employees framing walls on the second floor.   b) New apartment construction, building #1300 located at 10911 Tara Blvd., Lovejoy, GA, Second floor rear top plate: On or about 07/17/2019, and at times prior, the employer exposed employees to fall hazards over 31-feet to the lower level, in that fall protection was not provided to an employee walking the rear top plate engaged in framing activities.  c) New apartment construction, building #1300 located at 10911 Tara Blvd., Lovejoy, GA, Second floor end unit: On or about 07/17/2019, and at times prior, the employer exposed employees to fall hazards of 11-feet, 7-inches to the lower concrete surface, in that employees were not provided fall protection while using two 2x10's as a bridge to access an adjacent apartment unit located across the breezeway.   d) New apartment construction, building #1300 located at 10911 Tara Blvd., Lovejoy, GA, First floor breezeway: On or about 07/17/2019, and at times prior, the employer exposed employees to fall hazards of 11-feet to the lower level, in that guardrails or other fall protection was not provided in the breezeway on the first level.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  a) New apartment construction, building #1300 located at 10911 Tara Blvd., Lovejoy, GA, Front side: On or about 07/17/2019, and at times prior, the employer failed to inspect all of the electrical cords prior to the start of the work shift. A 50-ft. flexible/extension cord used to power a Makita (model 5007F) 7-1/4-inch circular saw had a damaged strain relief and a missing ground pin and was not repaired or removed from service prior to the start of the shift.
